| 1) Prices Excepting different agreements, current prices at the moment of dispatching the goods are applied. They are meant for goods sold ex-works (GIULIANOVA-TE) and net of V.A.T. 2) Deliveries The terms of delivery are approximate and do not bind GIPLAST Group srl. Giplast Group Srl is not responsible and it is not bound to any compensation for damages towards the customers for any delay in production or in deliveries, even if free delivered. 3) Production For production reasons, the ordered quantities can have a variation of +/- 10%. In case of custom made productions according to specific request of the customer, the production variation can reach 20%. 4) Orders Once the orders have been affirmatively evaluated, Giplast Group Srl sends an order confirmation. Only after the customer approval of the confirmation, the order will be considered completely accepted. Giplast Group Srl is not bound to advise about eventual refusals of the orders received. Any cancellation of orders already in the course of production must be agreed with Giplast Group Srl in advance. Any changes on the goods already in production won't be accepted The issue of the order implies the acceptance of the sales conditions 5) Features and dimensions and improper use of the products Weights, sizes, surfaces, shapes, dimensions and other data printed on the catalogue, are approximate and not binding and could undergo some changes or variations that GIPLAST Group srl could bring to its products. The only valid reference are the approved and delivered samples. 6) Complaints and warranties The buyer has the duty to check the products at their arrival. Any complaints will have to be sent in written form, by fax or by registered letter with returned receipt within 8 days from the date of receipt of the goods. Verbal notifications of non-conformity won't be taken into consideration. Giplast Group Srl won't grant any warranty for those products that have been handled or stocked in an irregular way. Giplast Group Srl won't recognize any right of compensation for damages caused by defective materials or for supplies not compliant with the order. Once the defect has been assessed, Giplast group Srl will replace in full or repair the goods. All returns must be authorized beforehand in written form by GIPLAST Group srl. 7) Deliveries Unless differently agreed, the cost for the transport is always at the customer's charge. For the delivery of the ordered goods Giplast Group Srl can use not only national and international forwarding Agents, but also occasional ones. In any case, the goods is always delivered at the customer's risk, even if it is a duty free port. For those deliveries with a value lowr than 500 €, even if a free port was agreed, Giplast Group Srl will charge the transport costs. 8) Payments All payments of invoices must be done within the expiry date agreed upon. The delay in the payment of invoices, even if partial, imply the start of interest on arrears accrual according to the current rate. Any payments given to Agents or Representatives will be accepted, unless previously agreed with Giplast Group Srl. 9) Judicial disputes. For any dispute, the place of jurisdiction is the Court of Justice of Teramo "Division of Giulianova". |  |
